Terms of Service
Who provides the service
UpDownTracker (the “service”) is provided by Armantas Gurskis, operating under Lithuanian individual activity certificate No. 1384150, Lithuania (“we”, “us”). Contact: info@updowntracker.com. These terms form the agreement between you and us when you create an account or use the service.
The service
The service checks websites and public APIs you configure (HTTP status, response time and expected keywords), receives Heartbeat signals from your scheduled jobs, observes SSL certificates, DNS records and tracking code, records incidents and history, and sends alerts and reports by email. Active Tracking, where your plan includes it, opens your page in an isolated browser to verify tracking behaviour. Requests are made from our monitoring network, described on the monitoring network page.
Your account
You must be at least 18 years old and able to enter into a binding contract. Register with a verified email address and password or with Google sign-in, keep your credentials secure and keep your contact details accurate. You are responsible for activity under your account and for any additional alert recipients you add.
Targets and acceptable use
You may monitor only targets you own or are authorized to monitor, and you confirm this each time you add a target or change its address. You are responsible for the addresses, ports, keywords and integrations you configure. Our Acceptable Use Policy forms part of these terms. In particular, scanning of IP or port ranges, vulnerability scanning, brute force, denial of service and attempts to reach private or internal infrastructure are prohibited.
If we receive an abuse report or detect a risk to third parties or to the service, we may pause a monitor, block a destination or suspend an account while we investigate. Where practical we will tell you why.
Active Tracking
Active Tracking loads your page together with its third-party resources, may accept a cookie banner on your site to compare behaviour before and after consent, and records which tracking requests were observed. Use it only on sites where you are entitled to do so. These automated visits may appear in your own analytics.
Trial, plans and payment
A new Starter account is eligible for a 7-day trial without a payment card. The trial starts when the first monitor is successfully created. Starter supports up to 3 monitors, Pro up to 25 and Pro+ up to 100. Paid plans are billed monthly or annually in advance and renew automatically until cancelled. The price and any applicable taxes are shown before you confirm payment in Stripe-hosted Checkout; we never receive your full card details. Verified payment events, not the Checkout return page, activate or change your plan. If a renewal payment fails, Stripe may retry it; if the subscription remains unpaid, monitoring access ends.
Cancellation and refunds
You can cancel at any time in the Stripe Customer Portal; cancellation takes effect at the end of the current paid period and monitoring continues until then. Within 14 days of your first payment for a subscription you may ask for a full refund of that payment by emailing info@updowntracker.com, without giving a reason. We refund it to the original payment method within 14 days of your request and end the paid access. This also satisfies the statutory 14-day right of withdrawal for consumers in the European Union. Other payments are not refundable except where the law requires otherwise.
Availability and results
We aim to run checks on schedule but do not guarantee uninterrupted operation, a particular detection time or the delivery of every alert. Results depend on the target, networks, DNS and third parties, and can include false alarms or missed events. We may pause monitoring for maintenance, security or abuse prevention; such platform pauses are not reported as outages of your site. The service supports, but does not replace, your own operational monitoring.
Ending your account
You can delete your account in the application settings at any time; deletion removes your account data as described in the Privacy Policy. We may suspend or end your account for a serious or repeated breach of these terms, non-payment or unlawful use. When trial or paid access ends without deletion, monitoring stops while your monitors and history remain available, and a new subscription can resume monitoring.
Liability
To the extent permitted by law, we are not liable for indirect or consequential loss, lost profit, lost revenue or data, or loss caused by a missed or delayed alert, and our total liability for any claims in a 12-month period is limited to the amount you paid us for the service in that period. Nothing in these terms limits liability for intent or gross negligence, for death or personal injury, or your mandatory rights as a consumer.
Changes to these terms
We may update these terms when the service, the law or our providers change. We will notify you of material changes by email or in the application at least 14 days in advance where possible and ask you to accept the new version before continuing to use your account. If you do not agree, you can cancel and delete your account; if you prepaid for a period, you may ask for a refund of the unused part.
Governing law and disputes
These terms are governed by the law of the Republic of Lithuania. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence. Please contact us first so we can try to resolve any issue. Consumers may also refer disputes to the State Consumer Rights Protection Authority of Lithuania (vvtat.lrv.lt). Otherwise, disputes are resolved by the competent courts of Lithuania.
